Donald Trump Considers Banning Transgender People From Owning Guns

The Trump administration is reportedly considering a new policy that would prohibit transgender people from legally owning firearms. Sources inside the Justice Department confirm the proposal is being reviewed, using a recent tragic shooting in Minnesota as a catalyst for the potential restrictions.

What is the White House actually proposing.

An official from the Justice Department told CNN the goal is “to ensure that mentally ill individuals suffering from gender dysphoria are unable to obtain firearms”. The administration aims to use existing federal laws that remove gun rights from anyone legally deemed “mentally defective”.

However, medical experts and legal scholars immediately challenged this reasoning. Gender dysphoria, which the American Psychiatric Association defines as the distress a person may feel when their gender identity differs from their sex assigned at birth, is a recognised medical diagnosis. It is not, by itself, considered a mental illness that would legally disqualify a person from owning a firearm.

This isn’t based on medical science…

Legal precedent typically requires a specific judicial ruling on an individual’s mental fitness before their constitutional rights can be taken away. A blanket ban based on a medical diagnosis that affects an entire group of people is on shaky legal ground. The American Psychiatric Association has been clear that having a gender identity that differs from one’s assigned sex at birth is not a mental disorder.

This move follows a pattern of administration policies targeting the transgender community, including the ban on transgender people serving in the military and the reversal of healthcare protections for LGBTQIA+ individuals. Critics see the proposed ban as another piece of a broader political strategy, outlined in plans like Project 2025, which seeks to undo progress on LGBTQIA+ rights.

A dangerous precedent for everyone?

For many transgender Americans, who already face disproportionately high rates of violence and hate crimes, the ability to own a firearm is a matter of personal safety and self-defence. Removing that right would leave an already vulnerable population with fewer options to protect themselves.

Organisations like the American Civil Liberties Union (ACLU) have condemned the proposal. The ACLU called the potential ban “a dangerous and unprecedented attack on both the Second Amendment and the basic rights of transgender Americans”.

The Justice Department has not yet released a formal draft of the policy. For now, community advocates and legal groups are preparing to challenge any official action, standing firm against policies that single out and endanger our community.
