Full Terms and Conditions of Sale and Photographer Submissions
1. Privacy Assurance
We prioritise your privacy. All DNA shipments are discreetly packaged in opaque, unmarked packaging to ensure complete confidentiality. For further information, please view our full Privacy Policy here.
2. Shipping
DNA is mailed from New South Wales, Australia, via Australia Post for Australian recipients, and via airmail with Australia Post for all international deliveries.
- Australian Shipping Times: Orders will usually arrive within 7 business days; please allow up to 21 business days for occasional delays.
- International Shipping Times: Orders will usually arrive within 15 business days; please allow at least 28 business days due to possible postal, Customs, and Homeland Security (US) delays.
Shipping times may vary, and DNA is not responsible for delays. Refunds are not provided for delayed deliveries. Customers are responsible for ensuring that their postal address is accurate, as DNA is not responsible for the non-arrival of misaddressed orders.
Tracking and Proof of Delivery: Orders under 500g (19oz) are sent without tracking. Lack of tracking is not a valid reason for disputing charges or requesting a refund.
Undeliverable Orders: If returned as undeliverable, shipping costs will be deducted from the amount paid. Any remaining balance will be credited back to the original credit card or issued as a DNAstore credit if a refund is required.
Lost or Delayed Shipments: If an order doesn’t arrive despite being correctly addressed, we will generally re-send it once, free of charge. Before contacting us, please check with your local post office, as they may be holding your parcel, especially if it doesn’t fit in your mailbox.
Customs and Import Restrictions:
While DNA does not contain explicit content, some countries may restrict the sale of gay magazines. Please ensure your country allows the importation of DNA, as we are not responsible for items confiscated by customs or import agencies.
Some countries may impose Customs Duties, Goods and Services Tax, Duties or Tariffs if orders exceed a certain value. Although rare, such charges are borne by the customer. If in doubt, please check with your local government authority.
United States of America: From 29 August 2025, the United States has implemented tariffs on certain products. At this stage, there are no tariffs on magazines; however, this may change at any time. Currently, tariffs apply to Body Oils (10%) and to DNA Gear (ranging between 26% and 36%). These tariffs and amounts may change at any time depending on US government policy. Prices at the time of order include any applicable tariffs, which DNA pays in advance of shipping.
3. Returns and Order Cancellations
Non-refundable items include digital content, back issues, and subscription issues already accessed or partially viewed. If you cancel an order, you may receive DNAstore credit; refunds to credit cards incur a $5 fee.
Shipping Costs for Returns: Unless the product is defective or an item was shipped in error, the customer is responsible for both the original and return shipping costs.
4. Defective or Damaged Items
If you receive an item that is defective or damaged, please contact us within 14 days of receipt. We’ll arrange a replacement at no additional cost. For print magazines, replacements will be sent without requiring the return of the damaged issue.
Note: Some very old back issues, due to limited availability, may have slight scuffing or price stickers on covers. This is not considered a defect but rather a characteristic of limited archival stock.
5. Apparel Returns (Gear)
Unworn, unwashed apparel may be exchanged for a different size. Return shipping costs to DNA are the responsibility of the customer, and the cost of shipping the replacement item back to you will be recharged at the original shipping rate.
6. Subscription Cancellations
Print Subscription Cancellations: If you cancel a print subscription, you will receive a DNAstore credit calculated as follows:
- The total amount paid for the subscription,
- LESS the DNAstore RRP (retail price) of any issues already shipped and/or accessed online, plus applicable shipping costs,
- LESS the DNAstore RRP of any promotional items received as part of the subscription, whether provided as a free offer or at a discounted price.
Refund Option: If you paid by credit card and would prefer a refund instead of DNAstore credit, a $5 cancellation fee will apply.
Recurring Print Subscription Cancellations:
- Monthly Recurring Print Subscriptions: After your second issue’s payment has been processed, you can cancel at any time before your next monthly renewal is processed, either through MySubscription or by contacting us.
- Annual Recurring Print Subscriptions: You may cancel an annual recurring print subscription at any time before automatic renewal. If you cancel a recurring print subscription, you will continue to receive all print issues you’ve paid for until the end of the subscription term. You can cancel through MySubscription or by contacting us.
7. Digital and Online Edition Access
DNA Digital and Online Editions are provided through our digital provider, Pocketmags. To access these editions, link your DNA subscription with Pocketmags, either through the in-app function (for Digital Editions) or via the Pocketmags website (for Online Editions).
Print Subscribers:
As a print subscriber, you also receive complimentary access to the DNA Digital and Online Editions as part of your subscription.
Subscriptions commence with the selected issue at the time of purchase. Back issues (print or digital) are not included in subscriptions unless expressly stated and must be purchased separately.
If you cancel your print subscription, including a recurring subscription, you will retain access to any digital issues already downloaded to the DNA (or Pocketmags) library app. You will continue to receive any remaining issues for your subscription term.
Digital and Online Only Subscribers:
Refunds are not issued once your first Digital or Online Edition has been added to your DNA app or Pocketmags library.
Subscriptions commence with the selected issue at the time of purchase. Back issues (print or digital) are not included in subscriptions unless expressly stated and must be purchased separately.
If you are unable to access the Digital or Online Editions on your device (e.g., due to an outdated device or operating system), a full refund will be provided, provided we receive your request within seven (7) days of purchase.
8. Non-Refundable Items
Some items are ineligible for refunds, including back issues, digital issues already accessed, subscription issues already accessed (online or digitally), and other online products (e.g., digital-only subscriptions, website-only subscriptions). Promotional products, digital access once downloaded, and monthly recurring digital and website-only subscriptions after charge are also non-refundable.
9. Refund Policy
Refunds are issued only to the same credit card used at purchase, with a $5 processing fee. Refer to Non-Refundable Items and Returns for specific exclusions.
Important: Please contact us before disputing a charge with your credit card provider. We are here to help resolve any issues promptly.
10. Publication Frequency Changes
Subscriptions are sold for a specific time period (e.g., “1 year”) rather than a fixed number of issues. If the publication frequency changes, the subscription will remain valid for the purchased time period, and no adjustments will be made to extend the term or guarantee a specific number of issues.
11. Promotions and Offers
Free Purchase Offers: Any free purchase offers, such as the DNA Calendars, are limited-time offers that may be revoked at any time. These offers are generally restricted to new subscribers unless otherwise stated.
12. Data Security and Liability
DNA employs industry-standard security measures, including data encryption and access controls, to protect your information. In the unlikely event of a data breach, DNA will notify affected individuals as required by law and work to mitigate unauthorised access. 13. Photographer Submissions
By submitting, photographers grant DNA a non-exclusive, royalty-free license to use, edit, and publish the photos across DNA’s media platforms, including digital, print, and promotional materials.
Community Support Policy:
DNA Magazine is committed to promoting inclusivity and supporting the LGBTQIA+ community. Photographers and models must be allies of the LGBTQIA+ community. Photographers are responsible for verifying that models align with these values by checking their social media and other public platforms.
DNA will not accept any images from photographers or models who support anti-LGBTQIA+ hate or rhetoric. Submissions not meeting this requirement will be rejected, and those photographers may be permanently banned from further collaboration or publication with DNA.
14. Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
15. Force Majeure
If an Event occurs beyond DNA’s reasonable control, DNA will make reasonable efforts to minimise impact. DNA may postpone or cancel production of issues during the Event and issue refunds in accordance with the DNA Cancellation and Refund Policy.
16. Definitions
To ensure clarity, here are definitions of key terms used within these Terms and Conditions:
- Submission License: A non-exclusive, royalty-free right granted by photographers to DNA, allowing DNA to use, edit, and publish submitted photos across its media platforms.
- DMCA (Digital Millennium Copyright Act): U.S. legislation outlining copyright protections, under which DNA honors valid requests to remove content infringing copyright.
- Model Release: Written permission from individuals featured in photographs, authorizing the photographer and DNA to use their image as specified.
- Event: An unforeseeable circumstance beyond DNA’s reasonable control, including but not limited to natural disasters, terrorism, governmental restrictions, and industrial disputes.
- DNAstore Credit: A credit issued by DNA, redeemable for future purchases in lieu of a refund, where applicable.
- DNAstore RRP: The regular retail price for DNA products as listed on the DNAstore.
